Jeep Recall: Harris Lowry Manton Researching Potential Class Action Against Chrysler
Harris Lowry Manton is currently researching a potential class action lawsuit against Chrysler Group, LLC.After refusing a requested recall from the National Highway Traffic Safety Administration (NHTSA) of 2.7 million Jeep Grand Cherokee and Jeep Liberty SUVs, Chrysler maintains that rear-end collisions that caused numerous fatalities are not the result of a dangerous design defect.
According to the Detroit News, NHTSA has performed a lengthy investigation into 32 fatal rear-impact crashes involving Grand Cherokees that killed 44 people, and five fatal rear-impact crashes involving the Liberty, which killed seven. Compared to other similar vehicles in rear-impact crashes, NHTSA claims in its report that the “Grand Cherokee and Liberty are poor performers.”
The location of the fuel tank – between the rear bumper and axle on the disputed models – and its plastic material could cause a higher susceptibility to deadly fires caused by rear-impact crashes, according to the NHTSA report. USA Today stated that NHTSA mentioned that automakers have been moving to “designs in which fuel tanks were located in less vulnerable locations than behind the rear axle.”
Clarence Ditlow, executive director of the Center for Auto Safety, made the following statement in a letter to Chrysler insisting the immediate recall of these vehicles: “Throughout America, children are dying in Jeeps in rear-impact crashes…All burned to death trapped in child seats designed to protect them.” His letter cites numerous crashes in which other passengers survived, but children perished “engulfed in flames.”
