Can Product Liability Be Criminal?
What many people don’t recognize is that product liability cases can also be criminal cases. A lot of times there will be a number of products that are sold, that start to injure people. Because of the expense of fixing that problem, then a lot of manufactures cover it up: they hide the evidence, they destroy the evidence, they start denying that there is anything wrong with their product. When you do that – when you start destroying evidence, lying to Federal Regulators, lying to Congress, not recalling defective products that the law requires that you actually recall and replace with something safe – then you run afoul of the criminal law.
One of the things that in my career that has been the most rewarding is when we have actually figured out there was a product that was defective, told the Regulators about it, and those products have been recalled. So even though we had one client, in many ways we had thousands of clients that we never met because we kept them from being injured. I think that’s probably the most rewarding thing that we do here in our law firm.
